By purchasing our product and by use of this site you accept these Terms and Conditions and you agree to be bound by them. Acceptance of these Terms and Conditions creates a binding contract between you and I Thee Snap, Inc that you will only use our services and products in a manner consistent with these Terms and Conditions. About the photos

In order to share your photos you grant I Thee Snap, Inc the non-exclusive, perpetual, universal, royalty-free right to use, download, upload, copy, print, reproduce, edit, publish and distribute all photos from I Thee Snap wedding cameras returned by you to I Thee Snap, Inc after your wedding.

I Thee Snap, Inc is committed to ensuring that our services remain a fun and safe place to share your wedding photos. Under these Terms and Conditions, I Thee Snap, Inc will not process and display content that is determined to be Prohibited Content. Generally, Prohibited Content includes content or other material that I Thee Snap, Inc considers to be:

1. Abusive, deceptive, pornographic, obscene, defamatory, slanderous, offensive, or otherwise inappropriate;
2. Comprising copyrighted material used without the express permission of the owner;
3. Violating or otherwise encroaching on the rights of others;
4. Containing viruses, worms, corrupt files, Trojan horses or other forms of corruptive code, or any other content which may compromise our services;
5. Advocating illegal activity;
6. Harming anyone, including minors; or,
7. Providing a link to any of the above;

I Thee Snap, Inc has the sole discretion to determine whether content is Prohibited Content, and any content submitted will most likely be subject to examination. I Thee Snap, Inc may delete, move, and edit content for any reason, at any time, without notice.

I Thee Snap, Inc in no way guarantees the accuracy, quality or appropriateness of content available through the website.

No Resale of Service

Your use of I Thee Snap services may be for personal purposes only. You will not (a) reproduce, duplicate, copy, sell, resell or exploit any part of the Service, or (b) use or access the service for any commercial purpose.

Indemnity

YOU WILL INDEMNIFY, DEFEND AND HOLD HARMLESS I THEE SNAP, INC, INCLUDING ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, LICENSORS, SUPPLIERS AND INFORMATION PROVIDERS, FROM AND AGAINST ALL LOSSES, CLAIMS, LIABILITIES, EXPENSES, DAMAGES AND COSTS, INCLUDING REASONABLE ATTORNEYS' FEES, RESULTING FROM ANY VIOLATION OF THESE TERMS OR ANY ACTIVITY RELATED TO THE SERVICE (INCLUDING NEGLIGENT OR WRONGFUL CONDUCT) BY YOU OR BY ANY OTHER PERSON ACCESSING THE SERVICE AS YOUR INVITEE.

Limitation of Liability

For purposes of this section, I Thee Snap, Inc includes its divisions, subsidiaries, successors, parent companies, and their employees, partners, principals, agents and representatives, and any third-party providers or sources of information or data.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNDER NO CIRCUMSTANCES SHALL I THEE SNAP, INC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY, EVEN IF I THEE SNAP, INC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, THAT RESULT FROM YOUR ACCESS OR USE OF, I THEE SNAP, INC SITE OR SERVICES, FROM ANY CHANGES OF THIS SITE OR ITS SERVICES, OR FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR SUBMISSIONS OR DATA, EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE. YOU SPECIFICALLY ACKNOWLEDGE THAT I THEE SNAP, INC IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING REST ENTIRELY WITH YOU. FURTHERMORE, I THEE SNAP, INC HAS NO LIABILITY TO YOU OR TO ANY THIRD PARTY FOR ANY THIRD-PARTY CONTENT UPLOADED ONTO OR DOWNLOADED FROM THE SITE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF INCIDENTAL, CONSEQUENTIAL OR OTHER TYPES OF DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.

Termination of services

You and your guests will have full access to your online photo albums for a period of one year. Expired photo albums will be removed to protect your privacy.

I Thee Snap cannot predict, notify or compensate for any server downtime that may be experienced

I Thee Snap, Inc may, in its sole discretion, terminate your use our services, and remove and discard any content at any time, without notice, for any reason, including: conduct that violates these Terms and Conditions or other policies or guidelines set forth by I Thee Snap, Inc elsewhere or conduct I Thee Snap, Inc believes is harmful to other I Thee Snap users or the business of I Thee Snap, Inc. I Thee Snap, Inc will not be liable to you or any third-party for any termination of your access to our services.

Choice of Law

The state and federal courts of Illinois are the exclusive forum and venue to resolve any and all disputes arising out of or otherwise relating to these Terms and Conditions. You consent to personal jurisdiction and venue by the state and federal courts of the State of Illinois.

Sales Taxes

I Thee Snap, Inc shall automatically charge applicable sales tax (7.25%) for orders to be delivered to addresses within the state of Illinois.

Return Policy

At I Thee Snap, Inc.com we offer only quality merchandise. A full 100% refund will be issued to the customer if requested within 30 days after purchase and if the purchased wedding cameras are still unused. Customers who request a refund must first contact us at info@itheesnap.com to receive instructions for returning their purchase to us.

Copyright and Trademark

I Thee Snap, Inc claims no ownership rights in the photos from the wedding cameras in your web album. Photos from the web albums of our customers will not be used for marketing purposes or any other purposes without obtaining the customer’s express permission.

I Thee Snap is a registered trademark, and other I Thee Snap.com and I Thee Snap, Inc product names, service name, slogans or logos referenced in this web site are trademarks or registered trademarks of I Thee Snap, Inc. All other company, product or service names referenced in this web site are used for identification purposes only and are trademarks of their respective owners.

All images, text and any other content on this site are protected by copyright, trademark, patent or other proprietary rights and laws. I Thee Snap, Inc reserves its rights in and to all other content contained in the web site. Entire Agreement

These Terms and Conditions constitute the entire agreement between you and I Thee Snap, Inc governing your use of our services. You may also be subject to additional terms and conditions that may apply when you use I Thee Snap Affiliate services, third-party content, or third-party software.

The failure of I Thee Snap, Inc to exercise or enforce any Term will not constitute a waiver of such Term. If any Term is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties' intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.

Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to our services or these Terms and Conditions will be filed within one year after such claim or cause of action arose, or be forever barred.
